If you do not agree to these terms, please discontinue use immediately. You must be at least 18 years of age or have legal guardian supervision to use this service.

2. Service Description

Nityaved offers specialized resume intelligence tools designed for Indian job seekers:

• Free Basic Check: Provides an overall ATS compatibility percentage score.
• Paid Premium Report: Offers a detailed, downloadable report at a nominal price (starting from ₹99) featuring comprehensive analytics.
• ATS Gap Analysis: Performs advanced keyword gap checking and skills detection matches.
• Disclaimer on Results: The service is purely educational and informational. We provide estimates and recommendations but do not guarantee hiring outcomes, resume selections, or job placements.

3. Free and Paid Features

Our offering includes both free and fee-based premium components:

• Free baseline ATS scores are accessible to all platform users.
• The premium analytical reports are generated and delivered instantly in-app following successful payment clearance via Razorpay.
• All pricing (including premium report fees) is subject to prospective adjustments at our discretion.

4. Account Registration

To leverage our saved reports or dashboard utilities, account creation may be required:

• Account credential setup is securely managed via email and password using the SuperTokens provider.
• You are solely responsible for maintaining the privacy and security of your login details.
• You agree to notify Nityaved immediately at legal@nityaved.com of any unauthorized access to your account.

5. User Responsibilities

When interacting with Nityaved, you agree to adhere to the following duties:

• Ownership: You must only upload CVs and resume files that belong to you or for which you have explicit permission.
• Lying/Fraud: You agree to provide truthful and accurate metadata details.
• Evaluation: You are responsible for reviewing and verifying the accuracy of all parsed data before relying on it for your job applications.
• Malicious Code: You must not upload corrupt, modified, or malware-infected PDF files.

6. Prohibited Uses

The following activities are strictly prohibited on our platform:

• Engaging in reverse-engineering, decompilation, scraping, or automatic querying of our application and scoring API.
• Attempting to bypass authentication blocks or accessing other users' records.
• Misrepresenting platform analytics as official hiring certifications or government assessments.
• Using our communication lines for spamming, harassment, impersonation, or platform abuse.

7. Payments & Billing

Our payment gateway operates under safe checkout models:

• All payments are securely handled and cleared via Razorpay.
• We strictly do not collect, capture, or store payment card credentials on our servers.
• Full report rendering is conditional upon verified payment. If transaction authorization fails or is halted by your bank, the premium report will not generate or display.

8. Intellectual Property Rights

The distribution of platform copyrights is detailed below:

• Nityaved IP: All code, interface architecture, designs, layout text, scores, and brand icons are owned exclusively by Nityaved.
• Your Content: You retain complete ownership of your uploaded CV files.
• Limited License: You grant us a temporary, restricted, non-exclusive license to scan, analyze, and process your uploaded CV to generate your requested reports.

9. Disclaimers

The Nityaved services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. ATS compatibility scores are structural estimates computed based on common industry layouts and algorithms, and we make no guarantees that optimized resumes will pass any external enterprise ATS filters or result in direct hiring decisions.

10. Limitation of Liability

Under no circumstances shall Nityaved or its operators be held liable for any indirect, consequential, special, punitive, or incidental damages (including loss of employment opportunities or missed interviews) arising from platform use. Our total consolidated liability for any verified claims shall be strictly capped at the exact amount you paid to Nityaved for the specific transaction in question.

11. Governing Law

These terms shall be governed by, interpreted, and enforced in accordance with the laws of India. Any legal actions or proceedings arising from these terms shall be subject to the exclusive jurisdiction of the courts located at Pune, Maharashtra, India.

12. Dispute Resolution

In the event of a dispute, you agree to contact us at legal@nityaved.com first to pursue an informal resolution. If the matter remains unresolved after 30 working days of good faith negotiations, either party may escalate to a court of competent jurisdiction in Pune, Maharashtra.
